A frivolous lawsuit can be described as one that is filed despite the fact that both the plaintiff and the lawyer are fully aware that the lawsuit is grossly devoid of merit. It is also based on the fact that it does not confirm to a rational augmentation of the law. In such lawsuits there is no basis for the legal representative’s meticulous probe of the case.

The probe is done before the lawsuit is initiated in the court. The frivolous lawsuit can be termed accordingly, depending on the fact that the attorney delivers his judgment in virtuous loyalty. The court's time as well as the time of the other party, resources and legal fees is wasted in a frivolous lawsuit. In certain cases it may lead to restrictions being imposed by the court on the party or the lawyer who initiates the proceedings.

Most of the frivolous lawsuits are due to the fact that litigants acting on their own behalf frequently resort to airing thoughtless opinions. This is due to their imperfect acquaintance with legal technicalities.

The more widespread application of the expression "frivolous" in discussions related to political matters points to court cases founded on the theory of the incongruous. In such instances there is no connection between the ways of the defendant and the damages suffered by the applicant. In such lawsuits the declaration in compensation very much surpasses what one would anticipate from a short synopsis of the case.
